These Terms of Service ("Terms") govern your use of the mobile application Side Notes ("the App"), developed and maintained by JCSMSOFT.
By downloading, installing, or using the App, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use the App.
1. Description of the Service
Side Notes is a note-taking application designed to give you quick access to your personal notes from a floating handle over any other app.
The App may include:
- Quick notes with titles, colors, and text styles
- Task checklists
- Reminders and notifications
- Search, pinning, and archiving
- Version history for your notes
- Local backups, optionally protected with a master password
- An optional premium version, unlocked with a one-time purchase
2. Eligibility
You must be at least 13 years old to use the App. If you are under 18 years old, you must have permission from a parent or legal guardian.
3. User Accounts
Side Notes does not require account registration. The App does not store personal user profiles on its own servers.
4. Purchases and Payments
4.1 Free and Premium Access
Side Notes is free to use. An optional one-time in-app purchase unlocks the premium version, which includes additional and enhanced features.
4.2 Billing
All purchases are processed securely through the Google Play Store. The premium version is unlocked with a single payment: it is not a subscription, it does not renew automatically, and there are no recurring charges.
4.3 Refunds
Refunds are handled exclusively by Google Play in accordance with their refund policies.
5. Acceptable Use
You agree not to:
- Use the App for unlawful or harmful purposes
- Attempt to reverse engineer, decompile, or modify the App
- Circumvent payment or licensing systems
- Interfere with the operation or security of the App
6. Intellectual Property
All content included in the App — including text, design, branding, and features — is the property of JCSMSOFT and is protected by applicable intellectual property laws.
You are granted a limited, non-exclusive, non-transferable, revocable license to use the App for personal, non-commercial purposes.
7. Your Data and Master Password
IMPORTANT: Side Notes stores your notes locally on your device.
- Your notes are not synced to the cloud and are not sent to our servers.
- If you lose your device or uninstall the App, your notes can only be recovered from a backup you exported yourself.
- The master password is never stored anywhere and cannot be recovered. If you forget it, protected notes and encrypted backups remain locked.
You assume full responsibility for keeping your backups safe and for remembering your master password.
8. Third-Party Services
The App may use third-party services including:
- Firebase Analytics (Google LLC)
- Google Play Billing (in-app purchases)
- Google Play services (in-app review prompts)
These services operate under their own terms and privacy policies. We are not responsible for third-party service availability or practices.
9. Disclaimer of Warranties
The App is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to fitness for a particular purpose, reliability, or availability.
10. Limitation of Liability
To the maximum extent permitted by law, JCSMSOFT shall not be liable for:
- Indirect or consequential damages
- Loss of data
- Loss of access to protected notes or encrypted backups after forgetting the master password
- Temporary unavailability of the App or its online features
In any case, total liability shall not exceed the amount paid by you for the App or its premium version, if any, during the previous 12 months.
11. Termination
You may stop using the App at any time by uninstalling it. We reserve the right to restrict or terminate access if these Terms are violated.
12. Changes to These Terms
We may update these Terms from time to time. Continued use of the App after changes are published constitutes acceptance of the updated Terms.
13. Governing Law
These Terms shall be governed and interpreted in accordance with applicable laws.
